Covenants Committee Meeting Minutes

June 6, 2006

In Attendance:  Marvin Wagner, Jack Mounts, Jake Bernard, George Malhiot, Margie        Kramer, Toni Brown, Frank Kasmer, Nancy Garner

 Absent:  None

Marv reported that the CC&R Committee suggested changes to Architectural Guidelines have been accepted.

Discussion was held regarding fence issue approved by the Modification Committee which might exceed the homeowner’s private area.  Next door neighbor complained to the MC concerning the approval.  The MC stands by their decision.  The neighbor has requested a hearing before the CC&R Committee.  Sylva from Koger Management has told the homeowner not to proceed with the fencing project.  A hearing is possible for the CC&R meeting on June 2oth.

Discussion was held regarding the hearing process.  The CC&R Committee is a regulatory body.  What is the proper appeal process?  Do we accept the findings as a matter of fact or do we start from the very beginning of the matter?  Who attends?  Marv asked George to put together a hearing procedure.

The committee is to review Margie’s letter and Marv’s explanations of the CC&R changes we are asking homeowners to approve this fall.  Members are to be prepared to discuss at our next meeting.

The Chairman feels there should be a formalized process for lawn maintenance as timing is critical.  The warning notices from the MC should give the scope of the work and the specific date when the work is to be completed.  It was suggested that the MC and CC&R Committee meet in a joint  session to iron out some of the lawn issues.

Next meeting is 10 a.m. June 20th at the Community Center.  Future meeting dates are:  July 11th and 25th; August 1st and 15th.
