Covenants Committee Meeting Minutes

May 9, 2006

 

In Attendance:    Marvin Wagner , Jack Mounts, Nancy Garner, Jake Bernard, Frank Kasmer, George Malhiot

 Absent:               Barbara Chadwick

 Discussion:  Since Barbara Chadwick has attended only one meeting, Marvin Wagner will check with her to see if she intends to remain a member of the committee.  If that is not her intention, George Malhiot will be asked to replace her.

 The focus of the remainder of the meeting was to review the Design Guidelines, as requested by the Modifications Committee, to provide feedback.  The CC & R Committee made the following recommendations:

  1. Page 1 – no recommendations or comments

  1. Page 2 – no recommendations or comments; however, see comments regarding Appendix A concerning building setbacks

 

  1. Page 3( #1)

·        “which side areas must be kept free of turf but may be planted with approved shrubs” should be deleted, since this does not apply to this community.  Also, the setback figures are in conflict with those given in Appendix A (see comments regarding Appendix A)

  1. Page 5

·        1st paragraph – Section II. C4 should be changed to Section II. C3, since there is no C4. 

·        C – same change as 1st paragraph

·        CC&R Committee recommends that the Modifications Committee address pavers used as stepping stones

·        (i) CC & R committee recommends allowing 2 flagpoles, since the original Covenants are ambiguous, and the committee will be recommending this change when the community will be asked to vote.

·        (2nd paragraph) – Reword first sentence to read “All walls and yard fences must be constructed of matter conforming to Appendix C.”

·        (#4) – Remove “Neither Del Webb nor”

·        (1st paragraph) add “solar tubes” to the last sentence.

·        (# 2) Change wording first sentence to include statements about compliance with FCC rules.

·        (#1) “For Rent” needs to be deleted, since that inclusion has not as yet been voted upon by the community

·        (#3) This needs to be deleted, since that inclusion has not as yet been votes on by the community.

·        (#4) Add “ without written consent of the Board”

·        (top of page) change Children’s play equipment to “non-portable children’s play equipment” to conform with #3 on Page 10

·        Change Del Webb to Falls Run

·        Committee recommends that 5’ setback be changed to 10 and also include a clarification on how measurement is made

·        Change rear setback figure from 25’ to 20’ to be consistent with figures given on Page 3

·        (B) Remove last sentence

·        Remove comma after “Area as”

·        Remove “or Neighborhood Common Area

·        (Bottom of page) – Remove “Stone or boulders shall not be used as a bed-edging material.”  Members of the committee who previously served on Modifications Committee believe that the Mod Committee intended for that change to be made.
